Sum in Arrears Notice with no Default

Hi,

Back in 2011 I have a car finance agreement with Creation Consumer Finance that I defaulted on around NOV 2011, well I thought I did.

I have checked my credit file with all of the big 3 CRAs and there is no mention of the account under closed or open and no default placed.

I now have Lowell chasing the account. I have never acknowledged this debt and Lowell have been asking for payment via mail and even offered 40% off an £12K account. Today I have received Notice of Sums in Arrears letter and from that I am guessing that they have never defaulted the account.

I am mindful that the account is close to Statutory Barred and don't really want to correspond with them.

So am I correct that this account has not been defaulted? and if that is the case how do I play this the account approaching SB? Shouldn't they have defaulted the account after 3/4 missed payments?

    If you can’t see a default on your main credit reference files it seems one wasn’t added. The default should have been added 3-6 months after missed payments.

    The default isn’t actually when a statute barred date runs from anyway though. For most types of simple contract debts it usually runs from when you missed one or two contractual payments, depending on the wording of the agreement.

    Do not at this stage correspond with Lowell or respond in any way. Wait and see if anything further develops beyond the letters.
