Post 65 reports on a court case where a Keeper paid a PCN and issued a court claim for a misleading and aggressive action under the Protection from Unfair Trading Regulations 2008. (I think this has been amended).
Judge ruled in favour of the motorist due to lack of signage in relation to the Byelaw penalty.

Very interesting. Now will they change their ways or will they continue in the hope that no one else notices they are in the wrong?I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I rather suspect the latter. Court losses and costs are all part of the business model (just like the private parking sector). Where court costs do not exceed income and expenditure, profit ensues. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
