UKPC Claims form received after numerous parking charges.

I have recently received a claims form from the pirates that are UKPC. I have in the past received numerous tickets for over staying the 4 hours that you are allowed to park in the retail car park.
Originally my wife saw one of the first ones that I had received and paid the £150.00 on the letter much to my disapproval. Even after paying this charge they still continued to send me letters for the same charge. I phoned and spoke to a gentleman that stated that I had not paid and if I didn't pay then further charges would be added and I will be potentially taken to court. I could not find the text message that my wife got as confirmation as she had since broken her phone and had a replacement. I spoke to a few people who said to me that UKPC couldn't enforce the charges as you are not losing them revenue by over staying the stated time as technically its a free car park.

I continued to park in the car park whilst I was working close by thinking that these people were just chancers and had already had £150 out of me so I am gonna park there.

Fast forward several more charges and I now allegedly owe £1440.00 plus court costs etc.

Since then I have found the proof of the first one that was paid by sifting through my wife's bank statements.

I have had a read of the stickies here which are very helpful and have submitted online that I intend to defend.

Any help to get me out of this mess would be much appreciated as I really don't want to pay these clowns that amount of money.

    the Beavis case last year has blown a hole on the not a gpeol argument and the overstaying argument (because that is what he was defending)

    you now need to draft a skeleton defence (holding defence) so search the forum for 2016 versions of these that other people with an MCOL this year have drafted and ada[pt tp suit your own case

    a few months ago there was a flurry of UKPC ones so find those as they will be further ahead then you are

    your defence will major on no locus standii , poor signage , BPA CoP failures , NTK flaws or failures , POFA2012 etc

    Whilst you are doing that the VERY first thing you should do is acknowledge service of the claim on MCOL and selecting the acknowledgement of the claim section

    Tick the box 'you intend to defend in full'
    Do not put anything in the defence box

    Do not contest jurisdiction - providing you live in E&W

    Make a note of your ID / password /email account as you will need this to log back into the account when submitting the defence.

    NB The claim form will have an issue date stamped on it.
    Service is deemed 5 days after that date.
    You need to acknowledge the claim within 14 days from service and submit the initial defence by 28 days (from service).
    IF YOU MISS THESE DEADLINES YOU ARE LIKELY TO RECEIVE A DEFAULT JUDGMENT.

    UKPC are former clampers who have been involved in quite a number of sordid scams, for example

    Hull Trading Standards took them to court on 15 counts of fraud. UKPC won all but one, but only because they had a better lawyer, a Q.C. If I recall correctly

  • I Have done a little more digging on the situation and the area where I used to park is separate if you like from the main shopping car park.
    Its what Halfords use for customer parking and MOTs. Now I cant remember any signs being hung around there at the time although there are now and they look fairly new. People I have spoken to seem to think the same.

    This area is sort of tucked down the side and there is a huge sign before you go into the main car park stating that it is under patrol by UKPC, this also leads me to believe the signage wasn't up as there is even a gate separating the 2 car parks.

    Although I dont have any proof I strongly believe this to be a case of being misled.
