so I have emailed them the challenge as per template. let's see what they reply.

They will reject it. You want a POPLA code from them where you have a much better chance of killing this. A rejection from CEL should provide you with the code.

You already have 2 very powerful POPLA appeal points:

    1. No keeper liability (failure to meet PoFA deadlines for issuing the NtK).
    2. Grace periods.

Ignoring CEL often leads to court papers, so your dealing with this at an early stage plays more into your hands than theirs.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you for the positive advice. I really appreciate the inputs and supports from this forum and glad I did the research.
Just hope it will end soon with successful POPLA appeal.
    Cheers.

    'Soon' is relative.

    1. The PPC has 35 days to respond to your initial appeal with a rejection (and POPLA code), or a cancellation (highly unlikely).

    2. You have 28 days to submit your POPLA appeal - don't rush it, you've got plenty of time to 'get it right' with help from the forum.

    3. POPLA take between 4 - 6 weeks to adjudicate.

So this could run into early December.

Remember the POPLA decision is only binding on the PPC, not on you!

ok I will get back and ask some help with the popla appeal when PPC give the POPLA code. Hope they don't play balls with the code. I think someone mentioned in other thread that he didn't received the code after PPC reply
