UK holiday-hotel cancellation last minute how can i claim my money back?

We went on a camping holiday up to the north of Scotland. Our plan was then to stay at a hotel/lodge for a night before travelling to the next campsite. After the first few nights stay at the campsite my son fell unwell and we ended up having to come home early, i contacted the place we were due to stay at the evening before we were due to check in and booking.com (who we booked through) however given the late notice the hotel charged our card to the tune of £130 which is fair enough.

Can i claim the money back any way? I know you can claim things through your credit card (is it section 75?) however unsure if our circumstances would count or how to go about this?

I also have European travel insurance through my bank (£50 excess) however would be willing to pay that to get something back as at the moment things are tight. Have never made an insurance claim before so unsure if my son's D+V experience would count as a valid reason/insurance claim?

  • Section 75 won't be of any use as all this does is to make the credit supplier equally and jointly liable with the supplier of the goods or service should there be any breach of contract, something that hasn't happened here.

    The only way to know about claiming from your insurers is to check the terms of the policy and if you still aren't too sure, give them a call and explain what happened and see what they say.

    Did your son see a doctor?

  • Do you have medical evidence of his illness? If so you could approach your insurer if you have cover for curtailment. This would not be covered by s.75 or a chargeback.
  • thanks all, no he didn't see a doctor as he had a sickness bug (which we all caught consecutively over the next few days) so i'm thinking now an insurance claim seems unlikely now having read through documents i am presuming i will need a medical certificate?something i wouldn't have thought to get given the circumstances
  • At least contact your travel insurance to explain.
    They may well pay out a small claim without any evidence.
    (Well Lloyds platinum travel insurance did for me for a delayed flight)
  • I'd say you've next to no chance of claiming on your insurance. You have no proof he was ill. If insurance companies just took peoples word for things that cannot be checked, everyone would just make up excuses to claim.

    The attending doctor (or consultant) usually has to complete part of a claim form. As you didn't take your son to see one this wouldn't be possible.

    It's certainly not something your card provider can help you with.
