Hi All. I'm having problems with getting a mortgage due to a default on my credit file. Below is some insight into the problem.
Back in February 2008 i visited my local Royal bank of Scotland branch to change my address on file and close the account. When i left the bank i was under the impression that this had been done.
I was sadly mistaken. In July 2015 i received a letter from a debt recovery firm stating i owed RBS £353. As soon i i read this i contacted the bank to see what was going on. They looked through my records to see why my account was in arrears. The records didn't go back far enough to see so they agreed to cancel the £353 and finally close my account. I thought happy days, all sorted.
2 weeks ago i applied for a mortgage, which to my surprise i could only get one with a bad rate. With this i signed up to Experian to look at my credit file. On the file is a default from RBS. I contacted them again for an explanation and to put a complaint in. At no point was i told about the default when i complained the year before. A compalint was put in and has been knocked back. They still believe the default should be on my account due to the following.
In 2008 when i tried to close the account it was overdrawn by £43(somehow now they have managed to find this information). The account sat there with no activity until August 2013 when the refunded me £11 for interest charges. Then at the end of 2014 there terms and conditions changed meaning i would get charged a fixed amount until the account was settled. This happened for 3 months then it was sent to the debt collectors.
i have lived and owned 3 different properties since 2008 and been signed on the electoral role at each one. At no point have RBS contacted me since the day i visited the branch in 2008. I wasn't informed of the terms and conditions changes, nor was a served a default notice.
Im still in talks with the bank but they are being very difficult.
has anybody any advice on what i can do to sort my credit file out. I move out of my current house in 2 weeks time and have no mortgage for the new place.
Thanks

I've only just joine this forum so I'm in no position to help/offer advice however, I spent a lot of time reading the below thread. Unluckily for me the default I have wrongly against my name is from a phone contract so I'm not covered by the CCA however, am pretty sure it will help you with your situation forums.moneysavingexpert.com/showthread.php?t=16a 74391
The thread is call removing Suttons default
It's a shame none of the posters from this thread are active anymore as all the advice including the letter templates are really good. I hope this bump helps your post get the attention it deserves0
