Faulty Goods & Warranty

My son bought himself a graphics card for his PC in September 2014 from Scan.co.uk. In May of this year he started having problems with it. Upon checking on the Scan website he saw that the warranty was one year. He then contacted the manufacturer, Zotac, and found out that the warranty was actually 2 years -Scan swiftly changed the information on their website.

As the card was still within the two year warranty, Scan arranged for him to send the item back (at his own expense), upon receipt they forwarded it to the manufacturer. After a few weeks my son had heard nothing so he contacted Scan and they finally replied yesterday, informing him that they had heard nothing from the manufacturer and so were giving him a pro rata refund of approximately £70.

This, to me, doesn't really seem right or fair.

Any advice would be appreciated.

    They've offered a refund based on the age of the item and the use your son already had out of it. This is allowed.
    Did they also refund your son's postage and packing costs?

    I actually didn't know where this was going, as until I got to your question, it seemed like you had been given good service...

    Scan have more than fulfilled your statutory rights. If you think you have been treated unfairly under the terms of the warranty, you will need to refer to them specifically.

    What did he pay for the graphics card and how much would it cost to get a used one of the same age, condition etc?

    If less than £70, he's quids in. If more.....he could perhaps use that to try and get scan to increase their offer.

    Is that something they should do? He paid over £10 for delivery alone.

    Thanks for all the replies. Accepted that Scan are within their rights to offer pro-rata compensation.

    However, the Zotact GB warranty states:

    1. Terms of warranty
    Within the warranty period, ZOTAC or a third party engaged by ZOTAC will rectify defects in material and workmanship of ZOTAC products, at ZOTAC’s choice, by either providing a repair services or delivering a replacement product to you. Delivery of a follow-up model is deemed to be a replacement for these purposes as well.


    Should Zotac have offered a replacement if repair is not viable?

    The warranty is provided by the manufacturer so it is up to them to abide by the terms of their warranty not Scan.

    I suppose another option would be to tell Scan that you don't want the refund and would rather wait for the manufacturer to repair or replace. Is it possible that the manufacturer has gone under or been taken over by another company? If taken over then depending on what was agreed on the takeover they may not honour old warranties.

    I thought that the manufacturer had not replied ??
    The £70 has to be balanced against the original cost . The fact that its two years old . The fact that the problem may not be inherent nor a manufacturing fault but damage . To proof the problem was inherent you would need an independent report . Cards can be damaged by factors like case overheating or electrical supply not to mention damaging the golden fingers on installation .

    I would send a letter to Zotac GB personally .

    Scan has probably had the card replaced with a new one (or had their acc. credited) but Scan will not give you that as they only offer a fraction of the new cost back.

    In this instance the best option would have been to return the card yourself to the manufacturer with proof of purchase.
