POPLA Wing

Hi there,
I received a PCN way back in May 2015. Appealed to Wing, later POPLA. Finally I receive a letter last month from POPLA (Administered by The Ombudsman Service) saying they will consider my appeal. Letter stated "Wing Parking will have 21 days to submit a case file" Then I am allowed 14 days to comment on the information provided. it doesn't say working days so I assume it is talking about weekend days too.
"Information submitted by both parties will be made available for review by either party. The operator will review your information via our case handling portal and you will receive a copy of their information by post."
The 21 days have lapsed and I have not received their information by post, but by email.
Should I respond to POPLA that I have received nothing by post and so the appeal should be upheld, or should I just continue my response according to information seen in email from Wing?
As a side note I tried log into my appeal on POPLA and it said "Sorry, the information you have provided is invalid. Please check the details you have entered" There seems to be no way of logging in with my reference code.

I would do rebuttals based on the supplied email and also phone popla about your inability to login online
I am also suprised its with the ombudsman and not Wright Hassell ( WHOPLA )0 -
Thanks for the advice. Letter said Supreme Court has now made its decision, which means cases that are on hold can now receive a decision. The BPA appointed Wright Hassall...however Wright Hassall declared a conflict of interest on a number of cases, meaning that it was unable to consider the appeal. Ombudsman Services, the new administrator of POPLA will consider your appeal.
BLAH BLAH BLAH POOPOOPOO Its all a pointless waste of time and no doubt they will rule in favour of Wing but I will have the satisfaction of making these guys at least lift their fingers and do some kind of "work" before they even consider getting their hands on my hard earned cash. I work hard for it and so should they.0 -
that explanation is what I thought but you had not said so, so I surmised it
what I dont know from these pass throughs is now you get your popla code once it goes from WH to Ombudsman services and how you validate that code , hence why you ring popla and find out , as few seem to go down this route due to the conflict of interest0 -
A POPLA decision in favour of the PPC is not binding on you. No need to pay. Make them lift more fingers by taking you to court - while you raise just two fingers to them!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I was thinking to get in touch with POPLA, get my login fixed and get this appeal completed. TBH this is so old its ridiculous. Thankfully I noticed in another thread that including the fact that no NTK was ever sent should finish this off in my favour. I will add that in my rebuttal and that should be the end of it.

no I dont mean that
I meant that maybe fewer than 1% will be exported due to the conflict of interest, so the vast majority will be decided by WHOPLA and very few seem to go to popla due to the conflict of interest
ie:- if they are representing your PPC in other areas thay cannot be seen to remain impartial in deciding your case, whereas London Councils was impartial , as will be the Ombudsman Service where it has gone now
so dont read into replies subject matter that isnt there
its a simple timeline , London Councils put it on hold pending Beavis , then the BPA appointed the Ombudsman Service , then the BPA dithered over the stayed 4000 cases (free the 4000) , then they appointed WH to deal with the stayed cases , then WHOPLA have decided that they cannot deal with some cases due to the conflict of interest, so have referred them to the new popla via the BPA
nothing dubious about it , its a conflict of interest so they have passed the ball to another decision maker approved by the BPA , you have no alternative as you are not in control until the decision
but you can ignore the popla decision if you lose0
