Thanks people, when I said I couldn't find GAN, It was at that time as I had been looking at loads of similar threads across pepipo MSE and CAG, I've read lots of threads and just find it amazing that they are allowed/or not to do this after so many years, but now to throw another spanner in.. what does everyone think about BMPA? It appears from information received from these that Excel once they know the registered keeper isn't the driver that they shouldn't use that information to proceed with any further harassment in regards to sharing information under the data protection act and that they have to stop sending out letters!0

You can try that approach under the Data Protection Act by writing to them and demanding the stop processing your data under Section 10 of the Act. I haven't got chapter and verse on the detail, but you can look it up.
If you're going to issue such a letter, you need to have your plan of action ready in case they ignore it, so plenty of research is recommended.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
