Yes they can "really issue a defence". Whether or not that defence holds up is for the courts to decide. Seriously, you seem to be going round in circles here. The insurance company will ALWAYS try to do what THEY THINK will save them the most money.
End of the day, they are a business. With your friends, they obviously thought they would win and it would be cheaper to pay their solicitor than to pay them, in that case, the insurance company were wrong.
In your case they will take all the facts (previous court case, what injuries your friends sustained, their clients previous trustworthiness, etc, etc, etc) and then decide if they can wriggle their way out of paying you (in which case it's going to court) or if it is cheaper for them pay up and shut up.
They will ALWAYS go for what they think will end up as the cheapest option, and they have professionals (solicitors, loss adjusters, etc) who make these decisions. They are human like your or I, so who knows what they will decide. Sometimes humans make stupid decisions and fight to the bitter end just to make a point, other times logic prevails and they will see that from previous experience of this particular case, paying out will be cheaper for them.
You just don't know. That is the bottom line.0 -
