You simply need to search the forum for APCOA POPLA. This is very easy to win and the first appeal was simply a stepping stone to get here.

OK, I have received reply's, as you correctly stated they do not rely on POFA they say because the airport is covered by bylaws. They show signs which they say are clearly visible that say no stopping . They include the authority from birmingham airport letter and basically tell me to pay, but they do give me POPLA codes to appeal.

DO I go to the airport and try to take pictures of the signs to proved that they are difficult to read and that the drop off zone car park is ambiguous at best? plus what else normally works when you goto POPLA?

    Any help is greatly appreciated.

    Thank you.

Yes I did say they do not rely on POFA and therefore the template appeal does not always work and better tweaked.

Research some POPLA appeals and post up yours for critque before submitting.

Just be aware that the POPLA codes are time limited so make sure you don't leave too late.

@parkingwoes Do we have any indication, in terms of overall percentages, of the number of PCN's now being issued outside of the provisions of POFA? A wet finger in the air suggests that its an increasing number.

Sorry HO87 - didn't see this until now.

Don't have any statistics I am afraid, although the majority of the IPC issue outside of POFA plus some of the aforementioned BPA players CP Plus, Highview, Smart, CEL.

I am getting together my POPLA appeal. Just a question about the notice to keeper. The car is registered with DVLA in my wife name and when the parking company sent us the NTK letter it was for her. However, I emailed the appeal and said I was the keeper. I am sure I read on here somewhere that this is OK as my wife would not be able to do it. Is this how I should proceed now I have stated I am the keeper?

Your wife is the registered keeper whereas anyone can be the keeper on the day of the alleged event. The person in charge of the car can legally be the keeper. This person may or may not be the registered keeper.
I can't remember where this is lawfully written in stone, perhaps one of the experts here can remind me.

So, you can appeal as the keeper if you wish. Since you already made the initial appeal you can continue, or you can make an appeal in your wife's name.

The word 'keeper' is defined in Schedule 4 and may not be the 'registered keeper'.

The OP can appeal as 'keeper'. This is an easy one to win anyway.

But seeing as Bylaws are involved, won't this be put on hold for the moment by Popla. Plus, will the 6 months Statute of limitations apply ?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
