Hi,
Let me start by saying that I have read the advice already on this forum but I'm looking for something a little more specific to my situation.
I received a parking charge from UKCPS on 9th July due to failing to park within the bay markings, but I dispute the charge on the grounds that there was a fixed obstruction (cycle storage) at the back of the bay which prevented me from doing so. I'm pretty sure the bay used to be a standard bay with the cycle storage being added at a later date. The bay was clearly marked in exactly the same way as other standard bays on the site and there was no signage to advise of a change of use of the bay.
Do I have valid grounds to dispute the charge? And if so what protection do I have against the company seeking to recover the debt while the dispute remains open?
Also, having received the charge stuck to my windscreen on 9th July, I copied one of the helpful template letters from this forum and sent it to UKCPS on 29th July, just within the 21 day appeals limit. Today I received a Notice To Keeper letter, dated 9th August, which makes no reference to having received my appeal letter and is now demanding either the driver details or payment within 21 days.
What can I do if UKCPS simply ignore my appeal and start chasing payment?
Any advice is appreciated

Mitigation (what happened on the day) will never win an appeal so is pointless.
Did you keep proof that you sent the original appeal? (Screenshot or proof of posting if sent by post.)
For IPC members, the NEWBIES thread advises you to ignore anything and everything after the initial appeal has been made except real court papers.
Alternatively you can make an IAS appeal if you wish and then ignore anything and everything except real court papers.

there is no doubt in anyones mind that this is exactly what they will do, they do it daily and have done for years, its how they pay for fast cars and luxury holidays etc
no IF about it , it is their business model and they will stick to it like glue
you either pay , or IGNORE , for 6 years , unless you get court papers (MCOL)0 -
Have you complained to the landholder, citing the issue with the added cycle storage forcing you to park as per the UKCPS interpretation of 'not fully within'? This is the only route where 'mitigation' might help you. Get on to the landholder quickly to prevent this escalating.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
