  • The signs themselves say both VCS and Excel parking.

Given though what both the landowner and supermarket have said I reckon now VCS have found that they have had a hole dug for them and pushed into it which they can't dig themselves out of.

Bingo! Photos needed in case they later change them, before any court claim. Get your evidence stacked up now.

Didn't you get a copy of the contract when you appealed to the IAS.

    Yep just checked I did.

Will VCS issue debt collection letters before they issue court summons or will I just get a court summons in the post without debt collection letters?

VCS aren't normally quick to litigate, in fact prior to a couple of months ago I'd have advised that you'd be very unlucky to get court papers, but would follow the usual path of ignoring debt collector letters.

But they've recently embarked on a bit of a feeding frenzy of issuing court papers via their solicitors BW Legal. These are mainly quite old cases 3 years old or more. None have proceeded to court, but there's lots of froth and frenzy stirring - we don't know how it will all end. What we do know is that the Solicitors Regulation Authority is on BWL's tail.

Maybe VCS will be too consumed with what's going on currently with the above to be bothered by any more court cases to deal with - but maybe not. Who knows, all a bit unpredictable at the moment.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It's not a 'summons'! It's nothing criminal, just a Judge Rinder style discussion with evidence from both sides when you defend this at a hearing. Get those photos of ambiguous signs and any areas of no signage being readable...

You are in the same position as this person with an Excel one, except you lost at IAS so you can bet that BW Legal will pretend that loss at IAS is 'significant' and mislead you:

    https://forums.moneysavingexpert.com/discussion/5526408

You will get BW Legal letters soon and must respond, including to any Letter before Claim, and report them to the SRA and CSA and you will find discussed everywhere. So read other threads like I have told that person to start doing, there are over a hundred threads about BW Legal letters and claims this Summer, in this forum and on pepipoo where every 3rd or 4th thread is about their VCS and Excel threats and claims.

  • Just had a letter from VCS in the post saying that the PCN has been withdrawn probably because they were told to. Now I know why both the IAS and VCS told me not to contact the landowner or supermarket.
