  • Sorry to bump this up but this is still ongoing unfortunately. I have now been given 14 days to pay up or face further action. I did get my MP involved but she hasn't been a great help so far. Considering writing back but is there anything you'd especially recommend I'd include??

    The fact that UKCPS has just been temporarily banned by the DVLA for sanctionable breaches of the Code. Suggests rogue ticketing, and indeed there are recent cases in the public domain of UKCPS ticketing where there are no signs/on public highway, all sorts.

    The fact that this Government has pledged to regulate rogue parking firms (when they get round to it...).

    The fact that this case can be distinguished from the Beavis case, and that you will robustly defend any court claim.

  • Please could you provide me with a source about UKCPS being banned? I'd like to include it in my correspondence. Also, what is the Beavis case?

    Should I put these things to UKCPS as well as my MP? thanks!

    I'd suggest searching the forum for the word 'UKCPS' - you will learn all you need to know from recent threads since they were banned in October (we think they are now reinstated this week).

    And yes I would put it to both. Make yourself a hot potato they'd rather not take to a hearing. Be really robust and assertive in your words.

  • UKCPS have my name and address, but we never confirmed who was driving. car is registered to me, but could easily have been my wife driving at the time, does that make any difference?

    did the signage actually say "valid" blue badge , or just "blue badge holders - badges must be displayed" , you WERE a blue badge holder and "a" blue badge WAS displayed

    not sure to be honest, don't remember seeing any signs (though I'm sure they are there)

    may be worth a revisit and a camera , if they wish to be pedantic , you can also be

    multiple tickets (ok a few yrs apart) regarding a blue badge are not going to go down well , in the first case (you won) they clerly at a later point had a VRN of a vehicle used to transport a disabled person (was it same car?) and this is now getting close to herasment , as a blue badge is not a legal requirement on a private car park

    It can help slightly later on if they try a small claim because the keeper can use a bit more in defence by relying upon the POFA 2012.

    You already proved the right to park there with the copy of your son's renewed Blue Badge early on. Did you complain to the Cinema Management, I would push that again, show them the letters you are getting by attaching copies of them to a formal 'Complaint regarding harassment and disability discrimination' by their agent. Quote some of the Equality Act 2010 about not harassing disabled people.

    Send it to Cineworld's Head Office if you already tried locally and drew a blank. Ask them if they are proud of how you are being persecuted as a family despite proving your son is disabled. It wasn't even as if you forgot to display a Blue Badge, just picked the wrong one up and they only actually apply to Council highways anyway; some of these firms jump on the back of the BB scheme to use it as an excuse to fine people. Simple as that. And it's not as if you ignored the unfair charge either; you tried to resolve a dispute that has now escalated and amounts to discrimination, and Cineworld remain liable for this unwarranted conduct (if they contracted UKCPS).
