smart Parking PCN

Hi Spent quite a while searching for help before this first post. Parked in small shopping outlet in Gainsborough Lincolnshire. Controlled by Smart parking ANPR system. However was not shopping but used gym. The gym has an agreement that members do not need to pay as long as reg number entered into system. This is done on a wall mounted tablet inside the gym. When you enter your number you get a message back saying validated. You do not get any further receipt or other printed form to confirm the validation. There is the rub. Received a PCN for period when using the gym. I did appeal to Smart Parking and they of course rejected my appeal even though I sent them gym details .....membership class booked time of entry and departure [which coincided with the times on PCN] I now have to appeal to POPLA. My question what would be my grounds for appeal as Smart Parking say I did not have a valid exemption.

    all the usual legal arguments as detailed in hundreds of other popla appeals this year on here and over on pepipoo forums

    example

    no contract
    poor signage
    ntk errors
    pofa2012 errors
    BPA CoP errors
    different to the Beavis case
    keeper not liable

    and possibly others too

    use the forum search box to find a dozen recent appeals and base yours on those examples because if you dont know what your popla appeal will consist of , you havent read enough recent popla drafts

    Did you enter your VRN of this occasion? If so, you have them by the short and curlies.
    You never know how far you can go until you go too far.

    complain to the gym, and tell them to call off the parking company.

    Like the NEWBIES thread says, when at POPLA stage, simply search the forum board for the name for the parking firm plus the word POPLA.

    'Smart POPLA'.

    Also it tells you to complain to the Gym (of course) and make merry hell.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
