Scarborough parking

Hello,

I've read the parking forum extensively however unfortunately a bit too late. We are where we are and looking to get some advice of what to do, and if I have any options.

I received a parking 'invoice', I was in car park for 11 minutes. I wrote to parking eye to say that I thought it was unreasonable. They then sent me POPLA number which I never got round to submitting. I now have letter from small claims court.

I don't know if I should settle or if there is anything else I can do?

    Acknowledge within 14 days. If you "do not get round to it" you get a default CCJ

  • I have responded to the letter. I agreed to mitigation. Does anyone have any advice of this process?

    I acknowledge from other forum posts that mitigation is not recommended, however if you have any info it would be greatly appreciated.

    I presume you mean mediation?

    You will find a lot of pressure to 'pay up' at the full price as, from reading of others who have decided to go via this route, the PPC is not prepared to accept anything less, and the mediator is only interested in getting this settled and away from the county court - they are most certainly not working on your behalf.

    Agreeing to mediation gives the suggestion that you agree you owe something, but perhaps not the full whack. IMHO, that makes it a bit more of a struggle in court to say you owe nothing.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    you should have used the popla code when it was provided , and seen this off at popla using clause #13 of the BPA CoP

    your defence will also need to point out clause #13 , plus other legal arguments, but you have made it much tougher in not using the popla code

    mediation is a no no
