I am unclear as to how the Equality Act applies? Can anyone clarify please?
the vehicle was over the line but parked in a hurry due an need to go to the loo and also because of driver on RHS. Space to left also unusable.
I am hoping the next step is that they cancel it or issue a POPLA code. We will see!
Incidentally the PCN says that after 14 days, £100 plus admin fees are payable. Essentially they offer a discount if paid within 14 days (reduction to £75) but surely that is just a BRIBERY to try and get peole to pay quickly and also not to appeal? If the appeal is within 14 days, they should not be allowed to bump up the charge.

Wait to see the response from UKPC, don't think for one minute they will listen, UKPC are not worthy of being part of the human race.
Then wait as they must send you a code for POPLA.
That is the time to come back here for help. Get a letter from your doctor about your gastric condition.
As far as bribery, of course it is and they know that many people will pay the reduced fee.
You may well have appealed in the correct time period but if they decline your appeal, the only next step is via POPLA.
Going through POPLA will cost UKPC money hence the discount does not apply then.
Do not be too concerned, this is a long way off any court action
and even then UKPC will now be very wary because the courts are acting in an odd manner with regards to UKPC which might well indicate that UKPC are being watched with the rubbish they try to bring to court.

I wonder if it ever was escalated to court etc whether they would consider that the space to the left was unusable anyway and so there is no 'consequential loss'? Basically UKPC are just exploiting their 'over the line' rule to make money when the rule is in fact redundant in this case.
After Beavis the parking companies have dropped the loss thing, they'll try and claim that by parking across the line you agreed to pay the contractual fee they are asking. They'll have framed the photos to make it look like you were some sort of monster parker.
I doubt they'd ever accept an initial appeal either; it's not in their interest to do so, but they can be pretty consistently beaten at POPLA.0 -
Yes they cleverly framed the pictures to exclude the vehicle to my right and also the exclude the post to my left making that space unusable. See image.
I am guessing that it will go to POPLA. They are bound to reject the initial appeal.
You say thay can be consistently beaten at POPLA? Even when parked over a line?
I still think the ticket was very unfair in the circumstances and I will fight them over it.

BPA Code of Practice states discount should be by at least 40% i.e. £60 not £75
.
"19.7 If prompt payment is made (defined as 14 days from
the issue of the parking charge notice) you must offer
a reduced payment to reflect your reduced costs in
collecting the charge. This reduction in cost should be by at
least 40% of the full charge."0 -
I am considering paying up despite feeling it is extremely 'unfair'.
I think an appeal might result in popla saying that the signs say to park in marked spaces and the car was over a line.
It appears that POPLA appeals on extenuating circumstances like this -
- Forced to park further left by vehicle on RHS
- Space to my left unusable anyway
- In a hurry to go to bathroom because of a medical condition
I am going to write to McDonalds and Homebase but even Customer services at Homebase said on the day that their employees are in disputes with UKPC!
Question - I realised that being in a great hurry I didn't have chance to look at signs until I came out of MCDonalds - to find a ticket issued about 12 minutes after initial parking. How long is the 'grace period' before a ticket is issued?? 12 minutes or so was not long enough to use the bathroom, get a drink and get back to the car!
