DWhite, get you partner to speak to his insure about claiming back the excess from the TP insurer.

Your excess isn't covered by your insurer.

You agree to pay it in the event of any claim for damage to your own property.

You need to claim it back yourself ( or instruct a solicitor or claim handler)

Which is exactly what the OP (OP's OH) has done at this stage.

His insurer should be claiming the full amount from the third parties insurer to cover their losses. As the accident was only three weeks ago its a very hasty payment from the ops insurer.

Why is it a hasty payment, they've agreed the payment for the bike ?.

Op, for the price of legal cover on top, you should have taken it probably under £20, now your no win no fee solicitor is going to take at least probably 25%.

My son was involved in a accident recently it was sorted in weeks, could he have held out for more, yes, but he accepted a offer he thought was fair !.

I never said excess was covered by your insurer but some will claim it back directly from the TP insurer. From Admiral:
Do I always have to pay the excess?
If it's proved the accident was the other person's fault and we recover the full cost from their insurer, the excess is refunded. So in effect, you don't lose out.

Because the claim should be against the third parties insurer as apparently the third party was at fault.

Has 3rd party insurer admitted liability? If they have, your partner is entitled to full recovery of all losses.

If your partner had legal cover, his insurer would recover his excess and try to obtain compensation for personal injury and loss of earnings.

In my experience 3rd party insurer's will refund the excess promptly, but only if they have admitted liability. Phone them.

Your solicitor should have explained the process for claiming compensation for personal injury and loss of earnings can take a very long time. In my experience circa 3 years.

I hope your partner is on the mend?

My partner has just had his insurance pay out for the bike, which was paid minus the excess. Is this standard even if he wasn't at fault?

If his insurance company paid out, then yes, it's standard.

If/when his insurance company is reimbursed by the other driver's company, he will receive payment for his excess.

Thank you, he didn't have legal cover with ihs insurer but he has been in touch with a no win no fee solicitor who seem happy to take the case.

A no-win-no-fee solicitor is unlikely to secure you the best outcome. You need to be talking the these guys. Andrew Dalton is the man to contact.
