You should have demanded your money back or picked an other car.
This car sounds like a problem.

There must be other cars out there in better condition. If it was an easy fix, why did'nt they do it before the sale?

cant be fixed on warranty as an existing fault unless you want to act fraudulently along with the dealer.
IMHO you were daft to go ahead with the purchase. Should have got your deposit back (goods not as described) and walked.

As already stated warranty will not cover pre existing faults and as it is an insurance policy if you try to claim on it by saying it is a new fault you would be commiting fraud, if they find out and take action say good bye to ever getting car or home insurance at reasonable price.

The other issue you now have is technically you agreed to buy a car with a known fault therefore accepting that fault. You will now have an even weaker case to force the dealer to repair and you have most likely waved your right to reject the car. Cant see the dealer ever fixing it.

So what's done is done, I was naive and fell for what the dealer told me. I contacted the previous owner after finding his number on the service history invoices, he said the only thing wrong with the car when he part ex'd it was the air con and specifically it needs a new compressor. At least that's peace of mind that there are no other problems with the car.

If I was to foot the bill would there be any chance I could reclaim money from the dealer/send him the invoice? He did write on the original deposit receipt that the air con needs fixing and I have the original advert which says the car has working air con/climate control.

People here are being very presumptuous and judgemental. We don't know if there is a third party warranty company and not just the dealers choice of words to say they will cover the repair

If it's on the invoice and they fail to repair it then you'd be on good grounds to take it elsewhere and recover costs.

Go with your gut instinct about the dealer, not comments on here

The dealer has actually written on the invoice 'Customer to bring back car to fix under warranty'.

How can he do that after knowing there is a fault and trying to fix it once already? Like people have said it would be fraudulent to claim for an existing problem

In that case take it back for him to fit a replacement compressor. If he fails to do this then you could get the work done elsewhere and then submit a claim against him.

If you go down this route get a few quotes (at least 3) and keep records of these for the claim.

Trading Standards have also got back to me saying I may have been misled into the purchase, by the fact the dealer said it could be repaired under warranty. I definitely think this is the case!

So do I need to give him another chance to fix it? I would rather get a few quotes myself where I know they will do a proper job
