Rejecting a car (just) outside of the 30 day period?

Here's the sorry tale. My Nephew bought a Audi RS3 for £26k. I think it was £6k down and £20k on the book. Anyway, 33 days later the car goes bang. Dealer doesn't want to know saying its down to "driver misuse", this si without even seeing the car or sending anyone to look at it. Finance company sent an Assessor who said its the piston(s) and there are some other issues, including evidence of previous front end damage and his opinion is my Nephew isn't at fault and the car should be rejected. New engine from Audi is £22k! Anyway, he doesn't want the car repaired and wants to reject it. Dealer says tough its outside the 30 day period and its not his problem. Finance company say they have elevated the case to their area manager and are waiting to hear back on what he says.
I believe the legality of the 30 day period aside, he is entitled to reject the car, SOGA, unfit for purpose etc. Anyone know where he actually stands with this?

Let the finance company deal with it, it is their car after all.
RE dealer reaction of driver misuse.... how do they know that? With that car and your nephew's (assumed) age, this would be their defualt position, but doesn't mean it is correct.
Personally had a sports car at 18, went bang, assumed to be my fault, proven failed oil pump and took ages to argue out with the dealer, but perserverance and legal assistance sorted that out for me.Life isn't about the number of breaths we take, but the moments that take our breath away. Best to just deal with the warranty company, send a letter to them outlining the issues, a time line and what you want to happen. CC in the supplying dealer, don't get involved in warranties, 30 days thing or dealing with Audi. Good luck! (how did you pay the deposit?)0

As mcpitman says, let the finance company deal.
The 30 day short term right to reject is only the start as far as the CRA is concerned. there is also a final right to reject, under s.24, which can be taken later but ONLY after the trader has been given one opportunity to repair or replace and has failed to (successfully) do so.
Given the cost of repair it's very unlikely they'll be able to repair economically so the final right to rejection will come in to play. the finance company should be able to push that through without too much aggro.0 -
