Parking charge notice

Hi, I have received a pcn overdue letter telling me I've got 28 days to pay before passed to debt recovery agent and goes up to 150 from 100. Can they put it up without a county court judgement? Can debt recovery firm recover money without county court judgement? If they take me to court can I be charged costs? Thanks

  • I've had a look but can't seem to to find anywhere about the charge increasing when passed to debt recovery firm. Would I have to pay the increased charge if taken to county court or the original amount.

    If you lost in court your would have to pay the original amount plus court fees plus up to £50 in solicitors' fees, but the odds of winning are in your favour as these charges are scams with dubious contracts, T&Cs, and many hoops for the PPCs to jump through.

    Ignore unless they issue a court claim or LBA.
    You never know how far you can go until you go too far.

    You seem to be mixing up, debt recovery scumbags with bailiffs.
    Debt recovery companies are used by PPC's to send out threatening letters, to con people into thinking they can enforce recovery, they can't they are just bullies you can ignore.

    They can and do plonk on any charges they think they can get awy with, it doesn't mean you should pay them, ignore anything except real court papers.

    Who was the PPC?

    Why didn't you appeal and just win at POPLA? We don't lose v Premier Park because their NTK is flawed and a keeper can appeal and win. Either way, relax. Under ten court claims issued per annum, from over 30K 'PCNs' issued each year, is hardly prolific 'legal eagle' stuff:

    And as I said, the keeper can't be held liable by their 'Notice to Keeper' (NTK). Just to check, what you are calling a 'PCN Overdue letter' - is that merely the NTK? The first letter, received a month or so after the parking ticket?

    If so then you are at appeal stage and should be merely submitting the BPA appeal template as keeper. DO NOT say who was driving. Your case is exactly the same as all the cases here, no different, so if you are at NTK stage, appeal as the keeper.

  • I've only recently came upon mse. I read on another site to make an offer which I did, of twenty pounds. It was rejected. So I took what I thought was the most popular advice and just ignored them. It started at sixty within 14 days then to 100 now to 150 if not paid in 30 days and passed to debt recovery agent.

    Actually it's not a bad thing that you made an offer. That looks reasonable if ever they choose you for their court claim number ten this year! Unlikely, sit tight if not at appeal stage!
