Fence repair

The fence between our our house and our neighbour is damaged to the extent that most of it is non-existant. The deeds of our house specify that the fence is jointly owned and any costs shared. Our neighbours house is council owned. Under the tenancy agreement the tenant is under no obligation to maintence the fence. I therefore have come to the conclusion that it is the council who should share the cost. However, they have refused point blank to have anything to do with it. Do they have a legal responsibilty to share such a cost?

Any advice appreciated.

    inform them that as they refuse to honour the deeds, you are having the work done, and will send them an invioce.
    have the fence repaired and send them an invoice for half the bill.
    see them in court if required. itll be fun.

    Even though a fence may be shared cost I think you'll find you can't force the other side to pay towards repair or a new fence if they don't wish to.

    They have no legal responsibility to pay, just because the deeds mention the fence is a shared one, if they have no desire to have the fence repaired or replaced.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.
