    Thanks all for the information.
    Yeah all of the letters have been addressed to the company and not myself, although when the IAS appeal was filled out my information was included in that.

    I'll send another letter now including all the information Edna Basher has mentioned and see what happens.

    Just another thing, will charge keep increasing while I'm disputing? or does this only happen when I ignore them?

    Who knows, you are dealing with an IPC member who are the low life in this industry.
    VCS do not understand the word "dispute" so expect their idiot debt collectors to add to the coffers

    Is the best course of action if they dismiss my appeal to just demand that I want no more involvement with the company and see them in court?

    Advice here is when your appeal is rejected you ignore all further correspondence/debt collectors etc unless you get any LBCC or correspondence from the court

    People who are assertive and reply well, seem less likely to get a claim, we think. Do not wait for a LBCCC, just respond to the stupid '£154 demand' as covered in upteen threads here every week.

    Hi just a little update and would just like a little of advice before I decided what to do.

    I appealed again stating what "Edna Basher" recommended and I got a response on the 24th saying:

    "You have stated that you had to stop to read the signs in order to understand our client's terms and conditions which are used to operate the area in question. Again confirming you stopped in a prohibited area and therefore are liable for the balance."

    Then at the bottom ...

    "In order to prevent further costs from being incurred we would be grateful if you would contact us within 7 days from the date of this letter to pay the balance"

    Then on the 26th I've received a claim form from the County Court Business Centre saying that my costs are now 234.32 and I have 14 days to appeal.

    Firstly, I feel BW Legal have gone about this wrong as they said I had 7 days to reply but going by the dates they applied for the CCJ the next day. Are they allowed to do this? They have automatically presumed that I am not going to pay?

    I'm a little unsure how to play this, if I appeal again and lose will I get a CCJ? or should I just ring them and say I'll pay the original amount?

    It all seems a little excessive for stopping a few seconds!

    excessive or not , take a reality check

    yes they can issue an MCOL if they wish to or are instructed to , although if they didnt allow time for a response this can feature in your defence

    no CCJ will heppen if you lost in court , provided you paid promptly and in full , typically within 28 days, it is deemed satisfied and that is the end of the matter

    its IGNORING the court and not paying the judgment that gets you the CCJ (which only a fool would do)

    as a court claim has started, you could try to negotiate but most people would say see it through and try to win and claim costs

    read the bargepole post linked in the NEWBIES sticky thread for what to do next, regarding acknowledging the claim , write nothing at all in the defence box

    ps:- it says nothing about appealing , it gives you 14 days to submit a holding defence , or an extra 14 days if you acknowledge it , so approx 28 days from the claim date (but in reality up to 33 days from that claim date)

    you cannot appeal this , its far too late to appeal it , you are defending yourself now , NOT APPEALING

    You do not have a CCJ. You have a claim form just like loads of people on here and on pepipoo, and you need to do the 'Acknowledgement of Service' online using the password on the front of the claim form.

    You are in the same boat as everyone else with one of the hundreds of BW Legal Claim forms flapping about right now. There are so many defences already shown in threads on pepipoo you cannot fail to find what you need to know here:

    Go back 20 pages, see what you need to do and crib from the defences shown.

    Yes this is a claim form but no, you will not 'get a CCJ' if you lose, only if you THEN refused to pay whatever the Judge might order (which would be almost certainly less than BW Legal are demanding now).

    And you have grounds to win and pay nothing, and to claim your own costs.

    Just read the threads linked, acknowledge the claim leaving the defence box blank. These shoddy claims are easy enough to throw a defence together for...there are sooo many to copy from. You are not alone but do not throw away all the good work so far by trying to ring BW Legal or trying to pay a lower amount and thinking if you bury your head in the sand it will then go away.

    You cannot pay a lower amount but you can defend this with a view to paying nothing at all.

    Come back please, once you have acknowledged the claim online, do not tick to 'contest jurisdiction' just that you want to 'defend in full'. Leave the defence blank.

    That extends your time to 28 days from the date the court papers were served. Come back and show us your draft appeal copied & pasted from all the dozens of others. You can do this, don't get it wrong, don't ring them. Don't panic. Start reading about people in exactly the same boat as you, none of them law experts but all of whom have put together a defence by reading other ones.

    DO NOT respond, if any poster with less than 1000 posts send you a pm (private message) offering to 'help' with the defence off-forum. People with few posts could be anyone, and not acting in your best interests/could even be from the dark side! So to get help you will need to keep updating this thread and we'll all chip in.

    I think that statement is gold dust for you should this get to court and confirms in writing the Catch 22 nature of the VCS 'stopping' entrapment model.
