Virgin Media wont let me cancel - I've been Miss-Sold

Hi,

I need some advice please and not sure what to do. I've purchased a new house from Red Row, i was told by the sales office at Red Row that they have a deal with Virgin Media where i can get the top tv , phone and broadband package free for 3 months and then if i don’t like it i can just cancel. They asked id wanted it so I thought well if its free for 3 months and i can just cancel then yeah i may as well have it.

I've been in the property for 6 months now and when i check my virgin media bills im paying a lot of money for something i don’t really use. I'm paying £105 for just TV and Broadband as they never installed the phone line as they said the exchange box was full and couldn’t connect me. So i thought i may as well just look elsewhere. So i found a very good deal with BT where i pay £6.64 a month for their unlimited 52Mb Infinity Fibre Broadband, Unlimited Weekend Calls, BT TV with BT Sports plus line rental is included in the £6.64 and its a 12 month contract, i thought sign me straight up! I signed up with BT last night, so today iv gone to cancel my Virgin Media services, they told me i cant cancel because im in a contract with them. I told them but i haven’t signed any contract with them, they said i don’t need to. So then i said to them, so why every month for the past 3 months have you guys been sending me a contract to sign? The lady said she’s not too sure but stated that i didn’t need to sign it as with them sending me a letter when i joined (i never joined or filled in any forms or signed a single thing, Red Row told Virgin to install the services on my property) she said it states i have 14 days in which to cancel. I never got a letter about so called if i don’t cancel within 14 days then it would automatically mean im in a contract with them.

But by law in order for there to be a contract in place don’t i need to sign something or they have my signature proving that iv agreed everything and that i will pay for their services for 12 months?

Virgin wont let me cancel, iv tried speaking to the lady and also spoke to her manager but they said im in a contract and cant cancel.

Can companies legally do that? As if so then i own a company myself, what if i sent 10,000 letters out to random people and said im going to charge for £105 a month for me to come knock on your door once a month and ask how are you. If you dont send me a letter back saying you dont want my 'Knock & How Are You Service" then it will mean your in a 12 month contract with me.

Any advice would be great please!

    But i wasnt the one that signed me up, Red Row are. But then that goes with what i was saying towards the end, about me sending 10,000 people a letter saying im going to start charging them £105 a month for me to knock on their door for me to ask how they are. Unless they cancelled within 14days of getting the letter then what? there now in a 12 month contract with me?

    It doesnt seem legal to me.

    You did not cancel and thereby entered into a contract .

    No a signature is not required .

    But Virgin are saying i had to cancel 14 days after joining (the date Red Row signed my property up for their services). So if that was the case then Red Row miss-sold me the service who are technically acting on behalf of Virgin Media by saying i can get it free for 3 months and then i can cancel where infact Virgin are saying i have to cancel within 14 days of joining.

    As for there not being a contract in place how has this been passed as legal. The UK laws are truely messed up, like i say i may aswell send 10,000 letters out to random people saying im going to start charging them for a madeup service unless they cancel within 14days.

    In that case go back to Redrow .

    Question was it free for three months ??
    Question where you able to cancel before the three months expired .

    If VM say no it was not free for three months and cancellation had to be within 14 days .
    Then the error is with the original information from Redrow either being wrong or misunderstood .

    Do they have your bank details ?

    Buy your own story, you didn't cancel after 3 months and still have the service so you are locked in.

    Personally I would cancel the BT quickly as you should be able to get out of that easily. Unless it's such a good deal it is worth it to have a phone line!

    I strongly agree. Otherwise the OP will shortly be stuck with two almost identical services or a large Early Termination of Contract (ETC) fee!

    Redrow offered you a deal (on behalf of virgin media) and you accepted the offer - so a contract was formed.

    If you send 10,000 people a letter offering them a deal and they accept the offer - then contracts exist, and they are bound by the terms of the contract.

    If they don't accept the offer, then no contracts exist.

    Just to let you know after giving Virgin a call again i can confirm they have now allowed me to cancel with them. The lady i spoke to this time didnt have an issue with me wanting to cancel as she checked the notes and she read it out what it said which said the following:

    "3 months free trial, no contract".

    Obvsiouly the other lady when i first tried to cancel didnt check the notes on the account saying i had no contract and could cancel at any time. On a plus note it seems Virgin owe me money as she said iv been over charged for the months i have paid so shes refunding me over £100, result!

    Issue resolved :cool:

    This happens all the time and its Red Row's fault not Virgin.

    Basically that Red Row Sales agent is getting commission from Red Row so say anything to get a sale.

    Basically the government have said new house builders need to open up there sites to Virgin, so that the new houses will have access to choice and not just the BT network.

    Virgin welcome this as house builders used to charge Virgin huge amounts of money. So Virgin went to them and said any customer you sign up we will give them the first 3 months free in addition to the new customer offer.

    Meaning the new sign up signs to a 12 or 18 month contract get the new customer discounts plus the first 3 months free.

    You need to go back to Red Row!
