Anyone successfully fought ParkingEye to remove a CCJ?

    Was is in a similar situation to yourself after recently finding out that i had a ccj against me from ParkingEye 2 years ago, please see my thread titled: ccj successfully set aside what next? Parking eye
    I had the ccj set aside last week by a very nice judge who seemed unimpressed that parking eye couldn't be bothered to send a representative in person (they state in their paperwork that this would not have been cost effective for them!) It really wasn't as bad as i expected, in my mind (mainly because i have never been inside a court before) i thought it was going to be like something on tv and i was so nervous. It was literally just me and the judge, who i was very respectful and polite to and informed by the usher to address to as Sir which i did. It lasted all of 5 minutes! You will be fine honestly, it was more about not knowing what to expect i think with me. Best of luck to you, will check back to see how you get on :)

    Great of you becci148 to give a first-hand experience report to the OP.

    Even among the regulars here, not many have personally gone through the small claims process (me included) but we pick up information through which to advise others, by receiving comments such as yours enabling us to build our knowledge base.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thank you Becci148. I'm glad you were successful with the set aside. Alas I wasn't so fortunate. The judge ruled quickly against me, because I had left it so long before applying for the set aside. She quoted a previous case where 30 days had been too long, mine was a lot more.
    So I can only advise anyone in a similar position to act quickly, apply for set aside immediately if possible. Because I didn't know the process and was terrified of going to court I put it off. Huge mistake. :-(
