ldkgroup.co.uk appeals form ?

Good afternoon
In mid received a PCN through the post with evidence pictures of No Valid Ticket £45 ( the mere fact that the pictures on notice don't show there was a ticket on the dash it had just blown over ) .I use this carpark regularly . I immediately posted a recorded letter to the appeals dept in Milton Keyes . A couple of weeks ago I received it back with stamp giving the reason of undeliverable as - Addressee gone away- ? . I wrote this letter as on my computer when I found a link to the electronic appeals form on LDKs website ( which took an age to find as well ) it has no link that can be opened. So whilst being away on holiday I arrive home yesterday and have just opened a DRP letter with as I have discovered by swatting up a pretty generic worded letter demanding £150. All I want to do is get a Popla number to start my appeal .
Can anyone provide me some information where to send an appeal to LDK .Also what to do about DRS letter ? I feel ignoring them (DRS) is the right way to go at the moment

    never send an appeal by recorded delivery , they can refuse it and it goes down as UNDELIVERED

    the place and method of appeal should be on the NTK from LDK

    There may be nothing wrong with the address, but the cheeky blighters are thought to deliberately not sign for recorded delivery so they have proof that they didn't receive an appeal, thus making people like you miss the appeal deadline.

    Try again but first class from a Post Office and get a free certificate of posting. This assumes the PC told you to respond by post. If it said online or by email then that is how you should have appealed.

    The parking scumpany will probably tell you have now missed the appeal deadline, so in your appeal add that the UK Government believes appeals should be allowed for up to a year.

    "It is the will of Parliament, as a result of the EU Consumer Rights Directive, that ADRs must imminently be made available for not less than a year."

    Use the BPA template in blue from the Sticky thread for NEWBIES.

    On the up side, at least you haven't given away the driver's details by having the letter returned to sender.

    If you're at debt collector stage you've missed the PPC's appeal deadline and getting a POPLA code from them now will be like getting blood out of a stone.

    Their 28 day deadline is arbitrary and does not meet with legislation which provides 12 months to enter an ADR process. But the only way to test this would be in court, but no record of anyone trying this as yet in the private parking sector.

    You could still send in an appeal (use the blue text template in the newbies FAQ sticky) and see whether the PPC defaults through lack of attention into rejecting your appeal and sending you a POPLA code. Even if you don't get one, it would show that you've been reasonable in trying to settle this should the PPC take court action against you. Highly unlikely - you'd only be their 2nd case in over 2.5 years! :)

    The date was 31st of May though I didn't get the initial letter till the 18th June. Wrote the mentioned appeal then waited got the returned appeal at 15 th July though its undeliverable date is the 5th .
    Didn't get a reminder or any other letters from LDK just this DRP letter .
    I understand I should have had another one from LDK before the DBS one but Hey Ho .........

    I would appeal online using a throwaway email address (gmail , outlook or yahoo mail) using the blue text appeal from the NEWBIES sticky thread , as keeper

    also send by first class mail and obtaining a free certificate of posting from the PO Counter staff tomorrow am (like you should have done in the first place)

    their NTK in mid june was out of time for POFA2012

    I am having trouble with this company too. I put in an appeal by email and got an email back saying I was unsuccessful and I had 14 days to pay £45. The date of the email was 18th July. Yesterday I also had a letter from DRP dated 20th July saying I now owe £150.

    I have a blue badge and I was parked in a designated area that said Blue badge holders only. No other notice was on the wall. There is a notice on another wall saying permit holders only. It was late when I arrived and could not see this notice and having gone back there, I struggled to read it anyway as it was so high up. But this notice was not on the disabled parking bays.
    I was visiting and staying the night with a friend in the flats where I parked.
    There is a very steep driveway up to the flats and it was impossible for me to walk up it and there was no way I could get a wheelchair up it!

    There is no phone number for LDK, the only way of contact is through the appeals form.

    I have been onto the Trust company that own the flats and they are now getting onto LDK. But they don't give LDK any guidelines of what they can or can't do in the carpark. LDK have all the control.

    Can they be done for being disabled unfriendly? I really don't know on this matter.

    you can certainly try a civil court claim under the EA2010 against the landowner/managing agent and LDK

    in effect a counter claim for breaching the EA2010 , which you would have to prove as the claimant

    ie:- fight fire with fire
