Would you be happy accepting an amount that would in turn buy a piece of hardware that is quite a big/noticeable decline in performance? That's like buying a Playstation 4 and ending up with a Playstation 3.

That's like buying a PS4 and it being replaced after two years with a PS4 which is two years old.0 -
To have 3 failures in just over 2 years would be extremely unlucky.
Have other people had problems with this card? (google)
Is the failure mode the same for all three?
Are the cards 'dead' or do they fail when stressed?
Have you monitored the GPU temps?
Are you overclocking?
Is your power supply OK? Not just the overall wattage but can each voltage rail supply sufficient current for the graphics card and everything else?0 -
You make a valid point, and no I am not faulting Overclockers at all. Their RMA process was great, but I shouldn't have to RMA it every year, GPU's are and should last longer. I dont overclock, I literally play games and do a little recording thats it.
The warranty was 2 years yes, these are the dates in which I had issues;
9th May 2014 (4 months 5 days from purchase) - First issue, RMA'd sent back the same card.
24th September 2015 (1 Year 4 Months 15 Days) - Second issue, different repaired card sent back to me.
25th July 2016 (10 Months 1 Day). - Third issue, current card.
The thing in my mind is, I want to replace or have a card at the same specification, £189 will not get me a card of same specification. Overclockers.co.uk, the closest Nvidia card of similar specification is the 960 I believe, thats £200 and its benchmarks are of a considerable lower value as per the 3D Mark score.
Btw, I did RMA the card in May.. I have RMA'd it twice.
Either way, it is what it is I just wont buy a Gainward card again, period. When you buy something, you expect it to last a fair amount of time, in my case it has not on 3 occasions and now I will have to settle for a second hand card if I want to get something of similar spec. Thanks for the help.
Firstly I think it's very pathetic that you accused them of bullying!. I read it all and they were nothing but helpul in their replies.
Yes GPU's should last longer than 2 years so that's why your getting a parcial refund for the graphics card. If you go onto eBay I can guarantee for £189 you could get a second hand card that is far more powerful than a £399 card from 2014!.
Also if your any kind of serious gamer you would know that systems need upgrading often to keep up with the latest games. So you should have expected to have replaced the graphics card anyway after 2 years. If I was in your position I would be extremely happy that I had an extra £189 to put towards a new and much better graphics card.
So really your in a better position no matter what you do either replace the card with a new better one or replace with a second hand one which is better!.0 -

At the 2nd failure my first port of call would of been gainward (who are/were Palit brand) they probably would of shipped a new card to you no question's asked under warranty (gigabyte did when mine failed)
you have also failed to give us any indication of what the actual fault is you are experiencing with the card, all you say is it crashes under 3d load. i think overclockers have been very good to you here, even though your transcript above is all 1 sided why not show us what you actually said to them aswell?0 -

You seem to be overlooking the fact that your current card is second hand. The way the law works is not to give you a brand new replacement. It only entitles you to a like for like replacement - including age, condition etc. So while you're complaining its not enough money to buy a brand new replacement card, its not part of your legal rights and legally would be considered a betterment.
If a replacement (or repair) is disproportionately costly in comparison to a refund (which can be reduced to take account usage you have had of the product), then you cannot force a repair or replacement.
Obviously they agree gpu's should last longer or they would not be offering a partial refund. Whats more, they seem to have offered a linear refund - something they didn't have to do (given how fast technology advances, its not entirely uncommon for electrical items to lose 50% of their value in the first year alone).You keep using that word. I take it you don't know much about PCs in the first place having bought a pre-build, the AMD RX 480 performs 50% better than the 960, there's NO requirement for you to go Nvidia again.

Surely £189.79 + VAT is £227.75?
That is 57% of the purchase price that you have had 29 months use out of. They are therefore implying that they would have expected it to last 50 months, or just over 4 years, which sounds reasonable to me.
