    Genuine question - is a letter sent to all occupiers stating that the management company will not be enforcing part of the lease "informal". Would a reasonable person find it "informal" or would they think that they could choose to install laminate without being asked to rip it out? (I'm aware the OPs laminate was already down).

    Edit: I have just seen you said OVER the laminate - now that is a good idea!!

    Edit above (Cheap carpet throughout may not cost £1000 but the OPs buyer has offered on a flat with laminate flooring not cheap carpet. If they decided to pull out that would be fair enough and the restriction would have lost the sale.)

    I think you can get cheapo carpet fitted for about £10 per sq meter. As most flats are 50m2 or less that's about half of what you are budgeting for - unless your flat is twice the size of average?

    I agree with above, don't bother contacting the managing company. Just put some cheap cheap carpet down for a couple of hundred quid, upload new photos to rightmove and let the new owners do what they want.
  • I think your £1000 cost for replacing the laminate with carpet is a bit over the top. Just buy the cheapest useable foam backed carpet you can find, leave the laminate in place, lay the carpet over the top and leave the next owner to decide what to do about the flooring.


    Just buy that super cheap cord carpet that has no backing, then you are less likely to have issues around the doors and cord carpet can be got for about £3 per meter 2. Contact the buyer and let them know whats going on, they probably wont mind as you are doing it to ensure a smooth sale and they can always take it up and bin it in about an hour before they move in.

    If you do lay some carpet you'll have to tell the buyer what's happened. What are their thoughts going to be? Have they said they want you to change it and they will be happy with whatever cheapo carpet you randomly choose? Even if they are not put off by the removal of the laminate, they may be put off by the fact the freeholder seems to interfere etc

    Are the management company going to send somebody round to check before they agree to unblock the sale?

    It's not a deed executed by the freeholder, so not "formal" in that sense.
    Would a reasonable person find it "informal"
    That isn't the relevant test.

    But this is all academic - a buyer isn't going to want to take over this argument with the management company.

    I was halfway through a sale when the management company's solicitors demanded a lump of cash for a stack of paperwork.

    My solicitor said they had all the paperwork they needed and I just ignored the management company and their solicitor.

    The sale went through no problem.
