Car Insurance

Nonsense. I've never seen any insurer rushing accept any liability for claims where personal injury is concerned
I would agre with you that they never rush.
However in compelling cases with monior injuries they will accept rather than spend tens of thousands arguing in court.
I agree that this isn't the case of the OP and if I were in their shoes I would complain.
It depends on two main factors i.e.
1) the potential cost of the claim vs the legal fees (so you can't compare a £500 case with cases that potentially cost millions).
2) and also the witness evidence. If 2 cars colide on a country road and there are no witnesses and no compelling evidence e.g. tyre marks, then there really isn't much point going to court as it's one persons word against another.
Getting back to the OPs case, if I were in their shoes I would use the free complaints system.0 -
Thanks for your comments. I did previously attempt to add to this, but it appears that the message did not come up!! Being a newby I musty have done something wrong. Hopefully will get the hang of it soon!!
I intend to take the matter to the Financial Ombudsman Service as in my opinion, my insurers (I have now since changed) were rubbish!0 -
Be aware that you have to exhaust your ex insurers own complaints procedure first, before the ombudsman will step in to review the case.0

mattymoo is right. Get their compalints procedure (it might be on their website or in documents you already have).
Follow the procedure.
You can only go to the ombudsman if you follow their process and reach "deadlock".
Sometimes they put you through several different levels before you reach this stage, so expect it to take some time and possibly 3 or 4 letters.0 -

I think that although they may not be public roads but you still have to obey markings and zebra crossings and you still can be prosecuted by the Police for offences in areas were the public are present. So you couldn't run into a pedestrian who is crossing on a zebra crossing because you think that as it is not a public road the RTA does not apply. The man without a signature.0
