Can I get a refund for a service I haven't used and didn't want

Hello,

I got a phone call one day, about signing up to the money club. They offered me a 28day trail for a pound. I asked them to send me some information out in the post first, although I was stupid enough to give them my bank details, but I understood it as I had to ring up again and confirm if I wanted to go ahead with it or not. Anyway the pound came out of my bank, so I was going to cancel, however as I have a little girl and I work, I didn't get round to it, till the day the full subscription came out of my bank of £98.00. (Which I don't recall anything about how much it would be after the trail)
So I rang up straight away and asked for my money back because I didn't want the service and I hadn't used it, but they are refusing to give me it back because it's out of the the four week trail. They started the membership from the first phone call (on the 16.06.16) we had which I didn't think was fair because there was no starting date on the letter I got just the the amount of money that would be debited. Anyway I rang up straight away when I saw the money had gone out my bank on the 15.07.16, so I don't see why they can't refund me? They also took the pound out of my account around the 23.07.16, which I would have thought that should have been when my trail started?

Hope that make sense, just need some help, cos I need that money :/

    What is this The Money Club ??

    Looks like you accepted the trial and did not cancel the ongoing subscription at the end of the trial .

    I don't really understand it, something to do with discounting shopping. They find deals, to try save you money or something along the lines of this. And yes but I rang up on the 15th which is the date the trail finished as that's when the subscription came out?

    Its an opt out, it would have stated you have a deadline to opt out before they take full payment.

    There is little chance of getting your money back as "I didn't get around to cancelling it" wont be covered. A similar scam...I mean scheme occurred a few Years ago, but most were unaware they had even signed up to it, and thus were refunded.

    The trial would have started the day AFTER the phone call, so on the 17th June. If you then ohined on the 15th July to cancel, this would be day 29, so out of the trial period.

    What terms and conditions were sent to you? What do they say about cancellation?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    If I am reading your post correctly you are saying you never actually agreed to any subscription, including even for the first month at the discount rate. Are sure about this - the company will have recorded the call?

    Also how did you pay?

    To the last comment - no I defiantly didn't confirm to start it when she rang I asked for information to be sent out and that all I had to do was ring up and confirm if I wanted to go ahead with it, so I had no idea that the membership had started till the stuff came through the post :/ and yeh someone is suppose to be listen to the recording and ringing me back, but they haven't as yet.

    So what did the letter say?

    They're required by law to give you certain information. If they haven't done this, you may still be within your cancellation period and may not be due them any money at all.

    Also how did they take the payment from your bank? Direct debit?
    Confirmation of distance contracts

    16.—(1) In the case of a distance contract the trader must give the consumer confirmation of the contract on a durable medium.

    (2) The confirmation must include all the information referred to in Schedule 2 unless the trader has already provided that information to the consumer on a durable medium prior to the conclusion of the distance contract.

    (3) If the contract is for the supply of digital content not on a tangible medium and the consumer has given the consent and acknowledgment referred to in regulation 37(1)(a) and (b), the confirmation must include confirmation of the consent and acknowledgement.

    (4) The confirmation must be provided within a reasonable time after the conclusion of the contract, but in any event—

    (a)not later than the time of delivery of any goods supplied under the contract, and

    (b)before performance begins of any service supplied under the contract.

    (5) For the purposes of paragraph (4), the confirmation is treated as provided as soon as the trader has sent it or done what is necessary to make it available to the consumer.

    I also wasn't aware they had started the membership from the first phone call, because there was no start date or finish date of the trail on the letter

    Trial ... the word you're looking for is trial. :)

    A trail is something entirely different.

    Yeh it went out as a direct debit, but I have rang my bank up and they are also looking into it. The only information they put on was the around about dates of when the pound will be taking out and the full subscription. I just feel a right idiot!
