Potential New Job and Redundancy

Hi Everybody,

I currently work for a large IT company but I have had a recent interview which I done quite well at. I should find out this week whether or not I have the role or not.

I have arrived at my current job today and they are offering voluntary redundancy, basically I need to put my name forward this week if I want to apply for redundancy and they either approve or reject.

Say I applied for it and my redundancy was approved, the date for contract termination is 30th September. However if I did manage to land this other job and they wanted me to start late August, would I be able to take 4 or 5 weeks unpaid leave whilst working in the new role? Not sure whether this is feasible or not.

The obvious option would be for me to ask whether I can bring forward the contract termination date but I'm sure a colleague has asked for this last year and it was rejected immediately.

    If you start another job then they won't have to make you redundant thus won't have to pay you anything

    I realise that however I was thinking if I could agree the redundancy along with agreed unpaid leave for 5/6 weeks, advising it was to re-train and look for alternative employment they would accept that and agree to it. I would then be able to start the new role when my unpaid leave starts???

    So you mean you stay with your current role (however not attending work as on leave) but are also employed by the new company too?

    Yes that's it - so go onto unpaid leave if my current company agree of course, but then when the unpaid leave starts I'd then take up work in my new role. So technically I'd have 2 jobs for 6 weeks or so but only actually be working one. I can't see any reason I can't do this legally but could be wrong??

    I think legally you can't work elsewhere and expect redundancy pay. Redundancy pay is not a bonus, it's to compensate you for losing your job but you have one to go to.

    The company would be mad not to have something about this not being an option in their policy relating to redundancy. You wouldn't be the first one to try it on, hence why most company will have a caveat that if the person is OFFERED a post before redundancy (sometimes even for months afterwards), they are not entitled to redundancy/have to refund it.

    The technical term for that would be "lying through your teeth" then? Most voluntary redundancy schemes have a condition about pre-existing job offers, and if they find out any time in the next six years, they can come after you for the money. And, of course, you are involving your new employer in the "lying through your teeth" - I can see you being unemployed if the current employer rolls up asking what is going on and how come they have been involved in this.

    Stuff like this has a habit of coming out - someone always finds out and tells on you.

    That's what I was looking for - I haven't seen the terms or conditions about VR however I do know they send out a large redundancy pack which will no doubt cover this position - i'll see if I can get a hold of it. I'd never jeopardise my new role therefore i'm 99% sure this is a no go - worth a try!!
