When I was in a similar position (internal transfer, new manager wanted me last week, old manager wanted to keep me for another six), HR advised me that there was nothing to stop me writing to my current manager, cc HR, advising that I was giving four weeks notice in order to move to the new dept.

    Old manager wasn't thrilled ...

How did you cope with your old manager's 'attitude'? Mine has sat me down and said he's not happy, can't see why I'm doing it (even though it s promotion and 7k more), has offered to match what I've been given in the new role, he's asked me if I think the new manager would be any different, do I consider the new manager to be higher than him (errrr yes, because he is......). He then refused to talk to me. It's just ridiculous. I could manage better knowing I was leaving on X date, but it's so up in the air.

I'm just waiting for new manager to call me back - he's away on business yesterday and today and so don't think it will be until tomorrow.

In the end, the worst about this is not your old managers attitude. It is the fact that you are sitting in between them like a tennis ball! Don't end up piggy in the middle. Because one day that could come back to bite you. You need to ask your new manager to resolve this because you are feeling that this will cause ill feeling around you which you never intended or wanted. It isn't your job to be "reporting" from one manager to the other - they need to talk to each other directly, and leave you out of it. It isn't professional of you to be saying that your manager hasn't looked at CV's to another manager higher up, and they shouldn't be leaving you in a position to have to do that. They should know what each is doing because the should be talking to each other!

if you gave notice then the old job can be stopped, as long as the new job exist you are good to go continuity and all that.

Your old manager cannot stop you leaving that job.
he could try to influence to make the new job not happen.

You could offer to be seconded back but want your reporting to be through the new manager.

Understand the pecking order of influence can the current manager make life/career a problem if not get on with your move.

can the person leaving the new job do the old job, that would be a solution that could work for everyone.

This is what my new manager is trying to do but finding it difficult.

He has now gone to his boss - the CEO which he said he didn't really want to do but said it wasnt possible for him to wait any longer than reasonable - the person currently in role really wants to leave.

Initially new manager suggested this. He said he would release me back for a week to train the new person, current manager said no.

Current manager can't really influence career prospects in a bad way.

The person leaving the job I am going to client do my role and wouldn't want to. She is looking at taking a few months off with no work. She had been asked to stay till I move over and agreed but would rather have had the summer off.

Provide your current manager with notice that you intend to transfer on a specific date to take up new role, cc in HR and new manager, there is no continuity of employment issue/ risk that I'm aware of from your post.

You intend to move, don't allow the move to be undermined by a pr1k.
    Don’t be a can’t, be a can.

Old manager was very quiet with me after I did it, but behaved like an adult.

It was at a university, so everyone was always very busy at that time of year. It was difficult for the old manager, but probably easier for them to manage without me than for the new dept.
