Mis sold bank account

Hi, looking for some help. On friday i made a complaint to bank of scotland regarding being mis sold my ultimate reward current account. My reason is that i got told i could no longer have an overdraft if i didnt take on the account. If i had just left it they would of cancelled overdraft and this making me in unauthourised overdraft, so i went ahead with it.
Monday i got a phone call back from them saying they think i have not been mis sold it. There reasons are because i have used the breakdown cover twice and registered 2 mobile phones in the time. I argued back saying if i am paying for it i might as well use them. I did use these so they are not lying however instill feel. I got mis sold it as said about overdraft above.
Do feel its worth fighting my case or am afighting a losing battle

Yes, this certainly could constitute mis-selling: stating a packaged account is required in order to have x (ie an overdraft in your case).
You can refer the matter to the Ombudsman. You can do this online via the FOS website, or call them and they'll post out a form.
They'll review the matter and contact the bank.Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.0 -

Even if they uphold your complaint, they can deduct the market cost for the items you have used.
However, your complaint seems to be an unprovable allegation and you used the benefits of the account. So, unless you have evidence to back up your allegation then it is a fairly easy rejection on their part.
You can refer the complaint to the FOS if you disagree. However, the success rate is around 1 in 10. Based on very limited info, it is easy to see why your complaint was rejected. It's also the weakest complaint going and the OP has no proof it happened. The OP used the packaged account benefits proving it was worth having and they knew about it (so a time bar could be invoked anyway)
The OP states the bank told him they were going to take away the OD facility (perfectly fine, not miss-selling, they simply didn't want to offer that facility to him presumably because they didn't view him as a risk worth having) - by offering an option of OD with a fee paying account they have some insurance in case the OD goes unpaid.
So in this case it sounds more like buyer's remorseSam Vimes' Boots Theory of Socioeconomic Unfairness:
