nope, watch your wording , you have admitted to being the driver in the above appeal

check it carefully , you are the hirer , you know the driver, you never admit or infer who the driver is (assume I was the driver)

Done! Just noticed their appeals section only lets you specify 'Keeper' or 'Driver' as an option, is it still smart to just email instead? Is saying 'Hirer' giving them a chance to weasel out as an incomplete appeal submission?

Yes you could choose 'keeper' on the dropdown menu, that's safe. But leave your actual appeal saying 'hirer'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've received this reply, could someone advise on the next step please? They are trying to say that they cannot register this as an appeal because I have appealed as keeper and the driver isn't named.

Pretty sure this makes no difference and is just an attempt to get people to name the driver. I think this has a reasonable chance of getting cancelled at this stage since you can't really argue with the photos, and this is just a stalling tactic.

"Thank you for your recent correspondence. As we cannot identify the driver of the vehicle in question from the document you have submitted, we are unable to register this submission as an appeal, considering that we are lacking in authorisation from the driver as to the validity of your submission.
Owing to this fact, you as the keeper will be held accountable for the charge. Unless you are able to provide us with the driver details.
    Kind Regards, MBW"
  • Here is my draft reply:

    Dear Sirs,

Thank you for your reply. As stated in my original correspondence - there will be no admissions as to who was driving and no assumptions can be drawn. There is no requirement for me to name the driver to appeal this speculative invoice as a keeper of the vehicle.

As stated previously you must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    Regards,

That looks OK to me, but I'm not an expert. Keep a screenshot/copy of anything you send.

Seems fine. If they refuse again, send a complaint email to the BPA:

    aos@britishparking.co.uk

Put in the subject line 'complaint about Minster Baywatch refusing to consider an appeal from the keeper - PCN ref:.......'
