If the insurers have used agreed industry standards to write off the car then I can't see that the GAP insurer will have a leg to stand on. The value of the car being argued over is a bit petty on their part and makes little difference to the claim. I suppose it could be argued that the repair could be carried out for less than the 60% figure but the insurer is generally considered the "expert". Good luck.

My insurers use a 60% repair to value ratio... a lot of insurance companies use 50%.
Ombudsman has all the paperwork now, so fingers crossed.
  • Just to let you know how I have got on with my claim against CLICK4GAP insurers. aka Direct Group.

I sent a complaint to the Financial Ombudsman about my GAP insurers refusing to pay out on my legitimate claim.
I have now received a cheque in full and final settlement from the Gap insurers click4gap aka Direct Group.
After speaking to the ombudsman I now know that she got in touch with the insurers and asked for all their paperwork. At which point they got back in touch with her and told her that they have reviewed their original decision and decided to settle my claim in full. Seems that they didnt want to be investigated and have their name on the Ombudsmans database.
The insurers phoned me today. I told him I didn't accept his apology and that he should go to hell. Feel much better now.
  • Yes, I believe that you are correct when you say that Direct Group appear to be some sort of administrator for click4gap, who it turns out are Future 45, I only found this out by the judgement from FOS. I, personally think they are all working in cahoots. I advised ombudsman that I am not happy that Future 45 have only had to pay me what they should have paid and that they have suffered no consequences as a result of their rejection of my claim, whereas I have had several months of stress plus loss of 3% interest of £8105. The ombudsman has now said that Future 45 should pay me 8% simple interest from the time they rejected my claim till the day they settled it. I look forward to receiving this amount from them.
I have taken out gap insurance for my new car but done it through my dealer. It all seems to be such a nightmare that I went with the easy option.
