2nd claim

Options
I received PPI from Egg via Claims Management Company.
Sometime later following a High Court Ruling these claims were reassessed, i received a further payment out of the blue.
The claims management company state that they are entitled to their % but i argue that the payment was due to a High Court decision and as such they have no claim.

Has anyone else had this experience, i cannot find anything in the terms and conditions that states i would pay again on any review or high court decision.

Regards
Stu.

There has been no high court decision (apart form the one in 2011 that said that the FSA was allowed to retrospectively apply the rules).

If you are mistaking the FCA requirement for some firms to go back and reassess old complaints (which is nothing to do with the high court) then the claims company have no right to any cut against the further amount paid unless they instigated the second review. That was confirmed by the claims management regulator in 2014. So, if they are chasing you for money, they are doing so fraudulently and in breach of their regulators' guidelines. You may wish to use that sort of language in your response to them.

    Who is the claims company?

Can you also please scan the correspondence demanding extra money and e-mail it to consumer@claimsregulation.gov.uk saying that they are ignoring the August 2014 claims regulation bulletin and fraudulently demanding money to which they are not entitled.
