Recent Default on old current account with overdraft

Hi All,
I'm new to the forum and just found out that a current account I haven't used for over 5 years has defaulted without me knowing. I got an alert from Experian, went in to check and there it was.
It looks like what has happened is that the debt has been sold form HSBC to 1st Credit Limited. I called them up and asked what was going on and they said that HSBC has issued the default just before the debt was sold to them.
I must share some responsibility since I should have closed the account or updated my address details. Is there anything I can do to remove the default or at least get the date of the default pushed back a few years? The last activity I had on the account must be 5 years ago. Is there any way I can find out when this was?
Any help would be really appreciated.

Hi there and welcome to MSE,
All you can do is make a complaint about backdating the default, I am afraid it's very unlikely you will be able to get it removed. Only incorrect data can be removed, so if money was owing and was called in and not paid then the default is accurate.
As far as backdating is concerned, it won't be clear cut either. You should ask when the account was called in, it can't have defaulted before that, and then look at the timescale from when the overdraft was called in to when the default was recorded. Unfortunately, the Information Commissioners Guidelines about defaults and overdrafts is not very clear. So, I would suggest you make a complaint to the debt collector - as they now own the debt, but you can also copy in HSBC - and escalate to the Financial Ombudsman Service if you are unhappy with the banks answer, good luck
