Advice please re claims company

Hi guys

I was recently contacted by ECC about PPI. I have previously been successful in claiming back a very small amount of PPI and didn't think any more was owing so I gave them some names of credit files as thought it was worth a final shot.

They've informed me that there was PPI on a credit card taken out with Egg (now Barclays) and have sent me paperwork to sign so they can send it off to reclaim.

I'm now thinking not to send back the paperwork but to log my own claim with Egg - can I do this? I don't have any account details. I feel wrong doing this but it would avoid the 36% fee or do I legally have to follow through the claim with ECC now?

    You can but if you signed any sort of contract you'll probably find they will be entitled to a share of the money or will at least bill you for their time (even though realistically all they did was minimum wage admin work ringing up a few places I'd expect a decent 3 figure bill)

    Do note also it's a complaint, not a claim, so you'll want to give the strongest argument going, a CMC will no doubt spin a web of lies and contradictory guff which may result in losing the case so you would be better doing it yourself if possible

  • I think if you haven't signed anything, you might be able to back out but it would also depend if you've given them details of your bank card as they may just take a 'backing out fee' from your bank account.

    If they rang you out of the blue and said they that you had PPI without actually first getting your authority to investigate send an e-mail complaining that either they have committed a criminal offence under the Data Protection Act 1999 by stealing your personal data or they have committed a criminal offence under the Fraud Act 2006 by making a false representation.

    Thanks for the advice guys I have signed some documents not sure if they cover that scenario but will leave the matter with them to be on the safe side

    You already have a contract then.
    It's too late to cancel without incurring a cost for "work" already done.

    The new document you have to sign is a letter of authority for the company to complain on your behalf with Egg(Barclays), but if you fail to sign it and complain alone the Claim Company will still want their cut.
