We already know that it was a 3rd party seller and not sold directly by Amazon. Amazon are wrong, anything imported from outside the EU (for obvious reasons even the EU may be excluded soon) over the £15 threshold is subject to VAT and customs duty.

That is why it is not always cheaper to buy abroad, although the base price may be cheaper the UK has its own taxing and importation system. If it was as simple as you seem to think nobody would ever buy anything in the UK where VAT is already added on and would import everything. Our country doesn't work like that.
You are getting the wrong end of the stick about what Amazon are saying - they speaking about their terms and conditions rather than the law.
It's a condition of use for sellers on Amazon that providing the buyer is in the UK they should not pay any more than what was agreed at the time of purchase.
To sell on Amazon a seller has to agree that they will cover import taxes if they are sending from out with the EU- most would add these on to this price/delivery and incorporate the cost that way, other will try and get away with not paying it.
However the chances are the A-Z Claim wouldn't be resolved until either tracking updates to show the item is on it's way back to the seller (this may not always be the case but generally speaking). The wait is frustrating but it will get resolved.
