    have you left the property yet if not don't go till you get it?

    The agency is coming to look at my property before I go. I expect my deposit and if I don't get it I'm not going.My place is better than what they gave it to me in.

    It would cost them money to go to court to get you out so they may as well pay you.

    It's very unusual to get your deposit back before vacating the property. In fact if you remain in the property after your tenancy has ended your LL can claim double rent from you under the Distress for Rent Act 1737.

    they could claim what they like they wouldn't have a hope in hell of getting it.

    its not going to happen either we are trusting each other.

    I disagreed to the claim and estate agent said that he will put together an end of tenancy statement and forward to the DPS and that I am able to challenge the claim if I wish.

    I've never had to do this, but isn't it me that is supposed to go to the DPS? Should I open up my own separate claim?

    Both parties need to be in agreement in order for the deposit to be released otherwise it's either the scheme's ADR or a court order to get it back.

    Make up your mind red devil either you are expecting your deposit back or you have already received a cheque. In any case, your experience is not relevant to the OP whose deposit is currently registered with DPS and who has moved out of the property.
