    Yes that's right.

It happened to me a few years back. I was told by my dentist's receptionist that I did not have to pay as I was in receipt of ESA.

I was quite shocked when I had the fine and bill a few months later! I called my dentist and they said they were sorry they thought I was on Income based ESA (which i wasn't) like your son I too was in receipt of CB ESA.

I also called up the people who had sent me the fine and charges and explained to them, the outcome was I just had to pay for my charges, the fine was taken off.

Maybe your son could do the same?

The form which he signed states very clearly that CB ESA is not a qualifying benefit for free dental treatment

He can try to negotiate with the NHSBSA who sent the fine, but it is very clear on the form and they may not agree to it

My son has a learning disability and it includes dyslexia so he would not have been able to check it or know what level of any benefits he was on . he said she just asked him to sign there which he did .

so speaking to the department they want the fine , I am going to the dentist tomorrow then I will send a letter .

I can get a form to get him treatment as he has a low income .
