Section 75

Hi, Can someone help me? I purchased some windows and doors with fitting from a double glazing company in September 2015. I paid a 20% deposit by credit card (Virgin) and the rest was buy now pay later for 12 months. The windows and doors were fitted in November. However, last week i find out that my doors and windows ( most of them) are not opening and shutting properly and are getting caught by the edge. basically they need to aligning or a service call from the installer. I have found out now that the installer has gone bust. I have contacted the card company and they have told me that as its been over 120 days i cannot make a claim. Please can someone shed some light onto this.

    You have been fobbed off, there is no time limit for S75 claims - raise a complaint with your bank / card issuer. If there was a finance company involved you have S75 protection through them as well.
  • Thanks for the quick reply. would my repairs for the windows and doors qualify for section 75.? As I am new to this is there a standard template or letter to use and send them to the credit card and the loan company. Thanks

    But the first thing you need to do is establish the cause of the problem.Given it's happened so soon it sounds like poor fitting or poor quality units, but there are other potential causes such as structural movement. As it's been over six months you'll almost certainly be asked to obtain an independent report stating that the issue is caused by something the fitter would have been responsible for remedying, the cost of this will be covered if the claim is successful.

    You have two avenues to pursue a S75 claim.

    Credit card company and finance company.
