I have an upgraded account and had never used any of the package until sadly we had to change flights due to a bereavement in the family. Would this now stop me from claiming back what I have paid with the package over the years or would I be able to claim less the payout?

You could complain the account was unsuitable but any refund you get would remove the money you were paid out. You are also limited in your complaint reasons as you knew about it and it was suitable.
What are your complaint reasons? Remember you are complaining you didn't want the account and shouldn't have been charged for it, not claiming money back.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

No, using a 'benefit' of a packaged account does not automatically negate any claim.
The value of that benefit is merely taken off any redress received.
If successful, you'll receive the monthly fees paid plus 8% pa interest. Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.0
