you keep coming back demanding to know

@Moneyineptitude we use forums to help each other with advice/suggestions and I have not demanded it from you or anyone else dear. We all post of our own free will and I have not asked that please you must respond to my posts, so please ignore.

You stated in your earlier post
As stated, they have no liability in your circumstance and they have applied a (generous IMHO) gesture of goodwill.
    :

However the gentleman on one of the forums had listed the following:

"1. The seller shall be held liable under Article 3 where the lack of conformity becomes apparent within two years as from delivery of the goods. If, under national legislation, the rights laid down in Article 3(2) are subject to a limitation period, that period shall not expire within a period of two years from the time of delivery."

Anyways as I stated above its not a demand, just sharing information which maybe of help to others.

    Thank you

Oh dear ... not the old "EU 2 year rule" again.

The requirements of the EU directive were enacted within the Sale of Goods Act (now superseded by the Consumer Rights Act), and the UK legislation gives you SIX years from purchase*, not two, within which to seek a remedy, so exceeds what the EU directive requires.

All the replies above relate to SOGA/CRA and are correct. What you've posted relative to that other forum does not change the advice in any way whatsoever.

As LG found liquid damage, whether you agree with them or not, you are very lucky Amazon are offering anything at all.

You also told us in your OP that the seller was FRElectronics, not amazon.

The supplier of the phone was FRElectronics but the order was fulfilled by Amazon so I would have thought that as payment was made directly to Amazon themselves and Amazon dealt with the whole ordering and delivery process that legally the contract of sale would be between the OP and Amazon. (although I may well be totally wrong on this).

Its sold by Frelectronics, fulfilled by amazon.

The same way when buying from amazon directly the order is sold by amazon EU sarl and fulfilled by amazon.co.uk ltd.

They do handle the customer service/returns for fulfilled products normally (since thats part of the service they provide to the seller) but the actual contract (and therefore statutory rights/contractual liability) remain between the OP and frelectronics.

Well when paypal collect your payment, your contracts still with the company who sold it to you, right?

Amazon are just acting as agents for the seller. If you needed a VAT invoice for the transaction, its the seller you need to ask.
