Perranporth / Gladstones

Hi,

I've checked the newbie thread, but couldn't see something that fit. I went on holiday to Perranporth last July (Last week in July 2015) in a hire vehicle. Assuming the hire company named me as a driver.

Got a letter on Friday this week from Gladstones saying I was illegally parked on the 26th June in a car park in Perranporth (over one year ago!)

1) First I've even heard of it - no letter from "Athens Security" or anyone else in the past.
2) Wasn't even in Perranporth in June 2015, I was there at the end of July. I live five hours away from there.
3) Never got a physical ticket in Perranporth or anywhere else.

Genuinely tempted to just bin the letter, given it's completely wrong and I couldn't see anything about appealing a year old thing that someone has just decided to pursue.

I do apologise for being thick - I know Gladstones have no power, but genuinely perplexed at this one.

I wonder if the same hire vehicle was taken there in June by the previous hirer and the Hire firm wrongly named you. Does the date match for when you had the vehicle? If not, complain to the Hire company and also respond to Gladstones telling them they have the wrong person.

Thanks, I'll send Gladstones a letter saying I didn't have the vehicle at that time and also complain to the hire company.

A months difference between the ticket date and me having the vehicle.

Right, so you can certainly blame the Hire company - I would do that immediately and in writing/by email.

Well, I sent my letter to Gladstones on the 9th July. Today I got a letter from MCOL saying that Athens Parking want £225.00 in court.

I've emailed them and I've basically given them a copy of the letter I sent to Gladstones and said if there is any further pursuit of this claim, I'll be countering for harassment.

I've also filled in the online response form on the MCOL website.

Wouldn't mind, the cheeky sods at Gladstones never even acknowledged my letter.

I think so, I acknowledged the claim but admitted no liability, just a response with a copy of the letter I sent Gladstones. Also told Gladstones that if the claim is not removed within 7 days, I'll counter claim for harassment and defamation. Idiots.

A friend of mine recently complained to the SRA about Gladstones and their totally unprofessional methods and the fact they were running a incestuous money making scam with their IPC members.

The SRA replied that there was no proof that Gladstones were involved in the IPC/IAS ???

The word that comes to mind is .... corruption

Have you still got a copy of the hire agreement or anything in writing to prove your case??

Also you need to contact the Hire company and get something in writing from them confirming they made a mistake.

I don't have a copy of the hire agreement to hand as it was over one year ago, so I have nothing really. Except for the fact I can prove I was in an office over 170 miles away on the day in question.

Oh and if push came to shove, I could probably get a copy of my credit card statement from when I hired it in July.

Push WILL come to shove and you need to email the hire firm again.

I really wish you hadn't rushed that response to MCOL. Sounds like you bunged in a short and ill-thought-out defence, when you could have had 28 days to talk this through with us first. If you put anything in the defence box or submitted this below, then this is your defence and you can't add anything now:

Let us know when you get the usual daft letter from Gladstones pretending the case is 'straightforward' and that it should be heard 'on the papers' rather than at a hearing at your local court, or they like to suggest that it is heard instead at the claimant's local court! Don't worry, you can steer it back to your court but you need to stay on top of this and check here first.

You URGENTLY need evidence as PROOF that you were not in charge of this hire vehicle on those dates. You really must hassle the hire firm, get on the phone and follow that with a formal complaint to their top banana (get his or her name) threatening them with a report to the BVRLA if they are members. You need to get them to admit their error, now.
