LA holding deposit

Hi, our letting agent is holding our deposit until we return a safe which was at the property.
The safe was not on the inventory and not built in, can they do this?

Deposit was registered with a deposit scheme.
We assumed the previous tenants (as it was not on the inventory). But the landlord is claiming they own it.

I would not worry about it, they want to claim it, they need to prove it was there when you moved in.0

Had something similar happen before, if its not on the inventory it doesn't exist.
We have moved into places where previous tenants have left all manner of things from knickers behind the fridge, a full washing machine ,paintings, tools, shed full of children's toys etc.
If you haven't acknowledged it exists then don't just plead ignorance and demand your deposit back.0 -

And when you left, you decided to take it with you?

Irrespective of the deposit registration, inventory or any other tenancy-related niceties, this seems to be a simple moral dilemma. In fact no dilemma at all.....0 -

If the safe was at the property when you moved in then it should still be there when you leave.
So if it isn't there do you know where it is? If you have got it you need to return it to the property along with anything else that was in the property when you moved in and that you have taken with you.
You do not have the right to remove items from rented properties just because they are not on the inventory. If you didn't buy it then it isn't yours.0 -
