Car accident help needed

Hi All,

Hoping I can get some advice from here. I was involved in an accident last week, I was on a dual carriageway which has 3 lanes, I was in the left Lane, wanting to change into the middle Lane, I checked my mirrors and both the right and middle Lane were clear so I moved into the middle Lane, I had been driving for around 5 seconds. When a highway agency vehicle has come into the middle Lane and hit into me. His passenger has jumped out and said it's my fault. Then the driver gets out and does the same thing. So then he gets back into his vehicle and drives off. But I managed to get a picture of his vehicle. I have then got the police to come out and have taken a statement etc.

My insurance company Hastings Direct have said it is 50/50 so have to claim off my own insurance first. Secondly they have put me through to a company called Albany Assistance who have arranged a third party company who took my vehicle on Friday. My policy states I should have received a courtesy vehicle within 24 hours. Today is Wednesday and have only received a courtesy vehicle. I have also heard back from Albany Assistance who have said the car is repairable and the costs to repair is £2,000. I value the car at £3k. I have contacted my insurance company who have said it's repairable etc hence the reason why they are not writing the car off for total loss. I have already has a bad experience with this repair company for not receiving a courtesy car within 24 hours and secondly I have been reading very bad reviews on the Internet for this company.

please advise. I prefer the car to be written off as the car won't be the same after an accident, I prefer the money to purchase a new vehicle as the mileage is quite high on my vehicle too..

    You cannot dictate that your car is written off.


    If you have signed up to Albany Assistance you may have some costs to pay them if you now wish to cancel them


    If you are determined to get away from Albany, and it is cost effective to cancel with them, then you can insist on your insurer dealing with your claim rather than using Albany
  • I have not signed anything with Albany. The car was towed away on Friday by the repair company and today after 4 days the courtesy car was given.

    Am I able to get a different company to deal with my claim?

    Yes, you can insist your insurer deals with your claim (assuming you have comprehensive cover)


    (But who is paying for your courtesy car you now have been given? If Albany are involved you may be too late to cancel with them - presumably you had to sign some sort of agreement over this courtesy car?)

    Hi Awaasiqbal,

    From your post it seems that we are completing a managed repair on your vehicle on behalf of your insurer – Hastings.

    The repairer is supposed to provide you with a courtesy vehicle if your vehicle is un-driveable and/or being repaired. Where they do not or cannot, we then provide a hire vehicle which can take more time.
