    A true inspiration to all those innocent motorists currently fighting the fight against these parasitic parking scumpanies. An intriguing set of events - almost felt there myself at times! :T:T:T:beer:

    As they are "forum picking", it rather shows that they have no real evidence and most of all THEY ARE SCARED STIFF OF THESE FORUMS

    Could be the word is out in the courts about Excel/VCS/BWLegal and their attempt to extort money.
    Seems that any solicitor representing this lot will have a tough time in the future

    The simple fact is that these parking companies have already played their hand in courts. There is little more they can say. We already know the cards they play but with the motorist there will always be other hands to play which the scum will never know until it happens and that is where the judge takes over.

    12 months ago, the scum won because the judges really were clueless.
    NOW, the judges have seen the light and this could be a direction from government to the courts.

    Maybe we don't need the DCLG to sort out the scammers, maybe the scammers will destroy themselves.

    If their scam no longer works in court, it becomes a dead industry who could only rely on people just paying the ticket value without question.

    And that must now be the target

    JB is not a 'solicitor bod', he is an Associate Chartered Legal Executive directly employed by Excel, or VCS depending on which version of his signature is in play.

    As such, he will be far more clued up than the average hired gun that BW Legal send in, because parking is what he deals with every day.

    But however good your advocacy skills might be, you will never win every case, and in this one he couldn't rely on POFA because the NTK wasn't compliant, and the original WS said they weren't relying on it.

    It all came down to the forum posts, and there was no conclusive evidence in those.

    If he could not rely on POFA because the NTK was not compliant surely he would have spent better time on the golf course than nit picking words from a forum.

    That's exactly what it came down to. In fact that's all we talked about for nearly 3 hours. He only had scraps to work with but he made the most of what he had.

    It bothers me a little that he had me on the ropes at one point esp as I'd dominated proceedings until that point and his case was so weak. It was my inexperience that allowed him to do this.

    He is skilled in his art (argument, manipulation) but I think a more experienced defendant would have killed him off rather than allowing him to "phoenix"

    Highly possible the judge saw that happening and understood you were not experienced.

    Yes, if he came up against a savvy person it would have knocked off 10 mins

    Even though he carries a grand title, he failed.
    I have seen good salesmen knock the socks off their managing director

    You have done a brilliant job and I hope you help others here and give them the confidence to win.
    If this is the best Excel can do, should be easy
