Your first option is to obtain of the ESA85 the medical report and go through it highlighting what you disagree on then ask DWP for a mandatory reconsideration, You have 1 month to ask for this and there is no time scale on how long this takes, If this option fails you can then appeal....

If you fail the appeal you either need to get a letter saying your condition has worsened or what the other person said, Job or JSA....
  • Hi thanks i am looking for work but prefer to do it off my own back so will not be applying for jsa. If i am unable to find work will this have any effect on my state pension when i reach retitement age because obviously i am no longer paying any national ins (It was paid whilst on IB due to previous earnings) i am 53

If you aren't caiming either JSA or ESA and not working then you won't be getting any NI credits which could have an effect on your state pension depending how many years you have so far and any future contributions.

You currently need 35 years NI contributions / credits to get full pension. If you are sure you have that covered claiming JSA might be less appealing. However, by claiming JSA you might get access to other help and support e.g. prescriptions paid, HB.

Could be worth you getting a state pension forecast - that would tell you how many years NI conts you actually have
  • Who do i ring to find out about my NI credits

My husband is doing lots of voluntary overtime at work so its not an issue or a matter of urgency at the moment. He is more than happy to do this for as long as the work is available or until i find work
