There was no permit email or paperwork. Just a UKPC permit which I was given by the letting agent when I began renting the property.
The permit itself does say on it that it must be displayed or a PCN will be issued...No mention of the amount of any charges on it though.

I've just read some more of the thread you linked...
I'm not sure when UKPC began 'managing' the parking but it before I moved here. The leaseholder may well have the permit papers but these weren't passed onto me.... Is this a good or bad thing for me?

I nearly said ask the leaseholder for whatever was handed out at the time but stopped myself, because there is NO WAY you can be bound by terms you didn't know about, to pay a sum you didn't know about because it was never adequately brought to the attention of drivers of your car, neither by signage nor by any paperwork, nor by wording on the permit itself. You were not given that information, FACT.
In fact, UKPC might try to use whatever was given to leaseholders at the time, in their evidence. But you can head that off by showing proof from the letting agent and a copy of the permit, showing that in fact, a tenant like you has never been served with any such contractual paperwork about the permit scheme at all.
That would leave them the signs, to prove the contract was 'clear and prominent'.
Can you take a short video of how the entrance looks and how it appears to a car driver in real time who drives in a parks with a permit in good faith, oblivious to any 'contract terms' at all? Most videos we've seen look far better evidence as a storyboard for the Judge, than isolated photos which focus on the signs more than would really be the case.PRIVATE 'PCN'? I'm worried that the signs are actually quite 'prominent' - not in terms of the actual display or wording, but the sheer number of them.
There's a large sign at the entrance stating private parking and terms of parking apply and to see the signs. Throughout the car park there are a lot of signs, including one only a few metres from the car.
Does this mean I most focus on the wording of the signs?0 -
Sounds like it, yes. Not a court situation example, but I helped someone win an off-forum POPLA appeal that I do for some people, when their car was parked right next to/under a sign. Case was won on the signage wording.
Also, I bet if you got a friend holding their mobile phone taking a video from the driver's seat, you will find the signs are not half as clear as you may think. I appreciate I'm sort of repeating early posts with this point but UKPC's FAQ for their services on their website states:
"Can we cancel charges that you've issued?"
"Yes. If we’ve ticketed a legitimate user in error, just let us know and we’ll cancel it immediately. You’re in total control at all times."
This goes to show, as I'm sure you knew already, that the managing agent could have these tickets cancelled easily. Is it worth me continuing to push this to them? (Despite their insistence of not getting involved in parking matters) And could the fact they say 'legitimate' users tickets can be cancelled be used to my advantage if this goes to court? In a way, it's an admission that legitimate users shouldn't be penalised..0 -
